The following are the terms and conditions of booking a tour with Cruise Tours Tauranga or Freewheeling Tours Limited. By making a booking through this website you agree to all booking conditions and standard terms of trade.
Pricing: All quoted prices are in NZD and include GST of 15%. They are correct at the time of publishing. However events beyond our control may result in price increases. The company reserves the right to pass on these increases until full payment has been received. When making a booking you must complete a booking form accepting on behalf of all your party the terms of these booking conditions.
How to Pay: Following your booking request via the online form, email or phone, we will send you an e-invoice for a deposit payment of 50% of the cost of the tour. The invoice will provide a link for your secure payment via your credit card. If you prefer to book and pay over the phone you can advise your credit card details to us directly but please do not email your credit card details as it is not secure to do so. Alternatively you can pay by internet banking transfer directly into our bank account. Please contact us for our bank details. We will also take cheques together with competed booking forms sent to us. Final payments should be reach us at least 14 days prior to your departure date. By prior arrangement, we will accept final payments on the day of the tour. If you book within 14 days of departure, full payment will be required at the time of booking.
Tour Booking Cancellations:
Cancellation at least 14 days prior to departure, 100% refund
Cancellation between 14 and 7 days prior to departure, 50% refund
Cancellation less than 7 days prior to departure, no refund
If we cancel for any reason you will receive a full refund. We recommend cancellation insurance to protect you against cancellation in the event of illness.
We appreciate your understanding.
Refunds: In the unlikely event that we are unable to provide your tour through our own fault (excluding terrorism and war) you will receive a full refund. If for any reason your ship is unable to dock in Tauranga Port, we will provide a full refund to you.
Changes to your tour: The tour itinerary will be followed as closely as advertised on this website but we reserve the right to alter this in the event of an incident outside our control. In some cases the tour may be affected by adverse weather or road conditions and in these instances alternative destinations and activities of a similar nature will be offered to you. Changes made by operators of attractions and activities we visit are outside our control but we will endeavour to minimise any disruptions of this type which may occur. Should you choose to shorten the tour for any reason then no refund is payable for any unused portion of the tour.
Timings: We have carefully planned our tours to return you to the ship in plenty of time before departure. If you are unable to rejoin the ship for any reason before it departs the port, Cruise Tours Tauranga and Freewheeling Tours will assist in arranging suitable transfers to the next port of call for you to rejoin the ship, but we will not be liable for any costs incurred. Travel insurance is available for such incidents.
Vehicles: Our vehicles are fully insured and licensed as Passenger Service vehicles. They hold a current Certificate of Fitness and will be driven by Passenger Service endorsed drivers. Where seat belts are fitted, it is the responsibility of the passengers to use them. No smoking will be allowed in the vehicles. Any damage caused to the vehicles by the hirer will be charged for.
Bike Hire/Self Guided Cycling Security Deposit/Client Responsibility: A valid credit card imprint is required as security in case of theft and/or damage for each hire bike prior to the commencement of the rental period. In case of loss or theft an amount of $600.00 New Zealand Dollars will be charged to the credit card, which is the replacement value of the bike. Any damage will be quoted on for repair/replacement by Hedgehog Bikes, Tauranga, and this amount will be charged to the Customer. If the Customer has paid for the rental by credit card, then that credit card number will be held as security for the duration of the bike hire. If the Customer has paid by other means then the Customer will need to provide a credit card imprint as security for the duration of the bike hire. Clients are at all times responsible for the safety and care of the bikes issued. All participants are required to adhere to New Zealand road rules at all times during their tour or bike hire.
Liability Waiver for Cycling Tours: All Cruise Tours Tauranga and Freewheeling Tours participants undertaking a cycling tour/hire will be required to sign a waiver of liability form prior to the commencement of their tour or bike hire. This waiver is an acceptance of full responsibility for their personal medical suitability to take part in their chosen itinerary and excluding Freewheeling Tours from any responsibility in the event of any accident or loss. Participants must also accept that all or any accidents which may occur during their tour or hire are their responsibility. Freewheeling Tours Limited is not responsible for any indirect or special loss, damage or injury of any kind whatsoever suffered by you arising directly or indirectly from any breach of contract or any negligence by us. Changes to Prices, Product Descriptions or Other Terms of Trade: The prices that appear on this site are valid at the time of publication. We reserve the right to make changes to our site and these terms and conditions and product descriptions and prices and such changes will take effect from the time they are published on this site. Bookings for which we have already received deposits will not incur any additional charges should the prices increase.
Claims and Complaints procedure: If a customer has a complaint during the tour, the customer should inform the Tour Guide immediately who will endeavour to resolve the matter. If the customer’s complaint cannot be resolved the client may write to Cruise Tours Tauranga or Freewheeling Tours Limited in New Zealand, This should be within 28 days of the completion of the tour.
Liabilities and Guarantees: Nothing in these Terms and Conditions is intended to be inconsistent with consumers' rights under the Fair Trading and Consumer Protection Acts. If there is any inconsistency then the Act shall prevail. To the maximum extent permitted by law we shall not be liable for any loss or profits or any consequential, indirect or special loss, damage or injury of any kind whatsoever suffered by you arising directly or indirectly from any breach of contract or any negligence by us. Our liability for any loss, damage or injury to you shall not in aggregate exceed the contract price of the goods or services supplied.
Privacy: We will only provide your personal information to other parties if it is necessary to do so to complete the transaction or if we are required by law to do so. For example, things like receiving and processing your credit card payments and arranging accommodation and activity reservations, or the delivery of goods, will require us to pass on your personal information. We will not supply any personal information to marketing and/or research companies or agency. Under the Privacy Act 1993, you have the right to ask to see the information we hold about you. If any of it is incorrect then we will amend it at your request.
Governing Law: Any agreement arising between us shall be interpreted and governed by the laws of New Zealand. Any disputes arising under the agreement or related to this site shall be dealt with by the courts of New Zealand.
